Streetsboro Council Buys Mayors Resignation, Elects Acting Mayor 05-02-2009
Streetsboro, OH - Streetsboro Mayor Tom Wagner resigned Saturday evening after receiving a deal from the City Council. The council also elected council member Art Scott as Acting Mayor until the election later this year.
Mayor Wagner’s resignation from office amid accusations of lewd comments, alcohol consumption, gun possession and other inappropriate behavior while on the job at City Hall.
In the deal the city will pay Wagner $60,000 and indemnify him of all potential legal actions against him, pending or future, that stem from his term as the Mayor of Streetsboro. The city will also pay all legal fees that the Mayor may incur from any such legal actions against Wagner.
City Council also agreed to withdraw all allegations made against Wagner, including gross misconduct, gross neglect of duty, misfeasance, malfeasance and others.
For the settlement payment of $60,000 the former mayor will receive either a 1099 or, at Wagner’s option, a net check subject to all appropriate P.E.R.S. and employee withholdings.
In exchange for the payment and the city’s agreement to pay Wagner’s legal expenses and possible judgments, the former mayor agreed to resign from office, and to make himself available and to cooperate in the defense of any claims which are made or will be made against him, the City of Streetsboro, City Council or it’s members which may result from the alleged conduct of his actions.
According to the city’s Law Director Blair Melling, the new acting mayor, Art Scott will serve as the Mayor until the general election in November.
After the council’s election, Acting Mayor told E-Portage that he has had his eye on the Mayor seat for some time and will definitely be making a run to retain it in the November election.
